   On 10 January 2022, the Market Misconduct Tribunal was informed regrettably that Mr Kenneth Kwok SC, chairman of the Tribunal tasked with enquiring into reporting on this matter, had suffered a serious medical setback such that he is and will be unable to discharge his duties as chairman. At the invitation of Mr Michael Lunn, chairman of the Tribunal, the parties made written submissions as to the best way forward in the proceedings in those circumstances.
   
   On 31 March 2022, Mr Kenneth Kwok’s term of office as chairman expired.
   
   On 6 April 2022, Mr Michael Lunn ordered that there be a hearing at the Tribunal at 4:45 pm on 21 April 2022 to address the issues arising, including the jurisdiction to re-constitute the Tribunal and whether or not the proceedings ought to be discontinued, stayed or dismissed.

   A directions hearing was held on 13 July 2022.

   A hearing of the application from the 2nd and 3rd Specified Persons for a permanent stay of the proceedings, sitting alone by the Chairman was held on 24 October 2022. The application was dismissed.
